Jennifer Hoover is a partner in the firm's Litigation and Insolvency & Creditors’ Rights Practice Group. She also serves as the Administrative Partner for the Wilmington, Delaware office of Benesch. She has experience in both transactional and litigation aspects of bankruptcy reorganizations, liquidations, and workouts. She regularly represents debtors, chapter 11 and chapter 7 trustees, creditors' committees, creditors, lenders, and parties to adversary proceedings in the United States Bankruptcy Court for the District of Delaware, the Eastern District of Pennsylvania, the District of New Jersey, and in other bankruptcy courts through pro hac admissions.  In addition, Jennifer has represented clients in all stages of litigation before the state and federal courts in Delaware, Pennsylvania, and New Jersey.  She has experience in representing clients who operate in a variety of industries, including energy, healthcare, lending, manufacturing, private equity, real estate, retail, technology, telecommunications, and transportation. 

The following are examples of Jennifer’s recent representative experience:

Insolvency & Creditors’ Rights

  • Representation of debtors, official committees of unsecured creditors, and trustees (chapter 11 trustees and liquidating trustees) in chapter 7 and 11 bankruptcy cases.
  • Representation of secured lenders, including special servicers of commercial mortgage backed securities and other secured lenders, in workouts, non-judicial restructurings and liquidations, foreclosure and collection proceedings, fraudulent conveyance actions, receivership proceedings, successor liability actions, and bankruptcies.
  • Representation of secured and unsecured creditors, warehousemen, motor carriers, DIP lenders, and bidders for and buyers of assets.
  • Representation of commercial landlords in insolvency and bankruptcy situations.

Commercial Litigation

  • Representation of parties in all aspects of commercial litigation.
  • Representation of trustees, liquidating trustees, boards of directors and shareholders in litigation involving breaches of fiduciary duties, corporate waste, fraud, misrepresentation, and misappropriation.
