Mr. Markette is of counsel with Benesch's Health Care Practice Group. His primary areas of practice are health law and litigation. Mr. Markette's wide range of health care clients includes home health, hospice and private duty providers. He assists his clients with Medicare and Medicaid compliance issues and Medicare and State licensure surveys. Additionally, Mr. Markette assists his clients with fraud and abuse matters, including reviewing proposed marketing arrangements and joint ventures, handling internal investigations, responding to government investigations and representing clients in audits and criminal investigations.
Mr. Markette works with his clients in structuring and closing business transactions including joint ventures and mergers and acquisitions. He also handles administrative, civil, and criminal litigation matters ranging from appeals of licensure actions to CMS and recoupment appeals to litigating wage and hour lawsuits in state and federal court. He has represented clients before state and federal courts, the Indiana State Department of Health, the Centers for Medicare and Medicaid Services, Indiana’s Family and Social Services Administration and the Indiana Supreme Court.
Mr. Markette frequently speaks on home health, hospice, and private duty regulatory compliance, fraud and abuse, home health and hospice regulation, joint ventures, HIPAA and HIPAA compliance and many other topics throughout the United States. He has written articles for numerous state associations, the Remington Report and other publications. He also writes the Homecare Law Blog, a blog discussing legal issues of interest to the home health, hospice and private duty industries.
Mr. Markette is certified in health care compliance by the Health Care Compliance Board.
