Law360 quoted Partner Michael Meuti in its coverage of arguments before the Washington Supreme Court in a case challenging Aeropostale’s shopper discount practices. Addressing the scope of the state’s private right of action, Meuti told the justices:
“The Legislature put two important guardrails on the private right of action: one is an injury — the consumer has to be worse off. And two, that injury has to be to business or property. Here, feeling worse about a purchase is not a cognizable injury.”
