Despite an increased federal focus on the enforceability of restrictive covenants and non-competition agreements after President Biden’s recent executive order, the enforceability of restrictive covenants and non-competition agreements remains a state issue with widely divergent standards. We explore many of those differences and which may be part of any potential federal guidance or regulation.
