Marc Blubaugh, Co-Chair of the firm’s Transportation & Logistics Practice Group, was quoted in FreightWaves regarding two petitions before the U.S. Supreme Court seeking to resolve conflicting circuit rulings on broker liability under the Federal Aviation Administration Authorization Act (FAAAA).
On behalf of the Transportation Intermediaries Association (TIA), Benesch filed an amicus brief in TQL v. Cox, warning that without clarity, small brokers face an “acute existential threat” and would be “forced to traverse a complex maze of dozens of regulatory and general tort-liability schemes.” Blubaugh noted that a Supreme Court conference on Montgomery v. Caribe Transport II was recently delayed, suggesting the justices may consider both cases together.
