Benesch Partner Michael Montgomery was mentioned in Law360 in connection with an Ohio federal judge’s decision to dismiss a shareholder class action against GrafTech International Ltd. and its former controlling shareholder, Brookfield Capital Partners and Brookfield Asset Management.
The suit alleged GrafTech concealed environmental contamination problems at its Monterrey, Mexico, plant, which was temporarily shut down in 2022, and further claimed Brookfield exercised control during the relevant period following its 2015 acquisition of GrafTech and the company’s 2018 IPO. Shareholders contended Brookfield remained a controlling shareholder from February 2019 through August 2023.
Judge Donald Nugent dismissed the claims, noting that the shareholder's allegations “contain no specific allegations of how the Brookfield defendants ‘exercised control’ at all.”
