Benesch Attorneys Featured in FreightWaves Article on Broker Liability Before the U.S. Supreme Court

Benesch Partner Marc Blubaugh and Managing Associate Nicholas Lacey were featured in a recent FreightWaves article titled “Trump administration backing C.H. Robinson on broker liability before SCOTUS.”

The article examines the growing national attention surrounding freight broker liability as the U.S. Supreme Court considers whether claims against brokers are preempted by federal law. Among the amicus briefs filed in support of C.H. Robinson was a submission on behalf of the Transportation Intermediaries Association (TIA), prepared by Blubaugh and Lacey of Benesch’s Transportation & Logistics Practice Group.

As highlighted in the article, the TIA’s brief argues that subjecting third-party logistics providers to state-law liability improperly shifts regulatory responsibility away from the federal government, which already oversees the industry. The brief emphasizes that imposing state-level obligations on brokers conflicts with the uniform federal framework governing interstate transportation.
