Benesch is pleased to announce a victory on behalf of electric off-road motorcycle company Surron following a one-week trial in a significant design patent case in the Western District of Texas.
Surron’s electric off-road motorcycle has become a standout in the U.S. market, and this case involved more than a straightforward infringement claim. The defendants, acting through former Surron insiders who served as their executives, adopted a design that was substantially the same as Surron’s patented design and launched numerous competing product. After a one-week jury trial, the jury found the defendants liable for patent infringement and found that the infringement was willful.
The case is now proceeding to the damages phase. “The jury’s verdict and the court’s findings send a clear message that innovation and original design will be protected, even against those who attempt to disguise infringement,” said Benesch Intellectual Property Partner Charles M. McMahon, who led the trial. “This result reflects the dedication and technical proficiency of our team, and we are honored to help Surron continue to lead in the market.”
