We have defended more than 150 consumer class actions brought under a broad array of consumer statutes in cases involving claims of consumer fraud, deceptive pricing, false advertising, federal and state privacy law and automatic renewal law violations, among others. Our team also has extensive experience in litigating cases involving the ADA, “Made in the USA” claims, return policies, gift card laws, call recording laws and alleged violations of California's Proposition 65. Well-versed in California law and its various regulations, we are often retained as California defense counsel.

Beyond litigation defense, a significant part of our practice centers on advising retailers on the myriad issues they encounter in building their brands. Not only are we fluent in applicable laws and regulations, but our advising practice incorporates our deep understanding of the retail industry (including trends and business interests) with our litigation proficiency so that our advice is always actionable and pragmatic. 

For these reasons, retailers often invite us to meet with their business teams to collaborate on solutions that work best for their companies. At the same time, many clients use us as outside marketing counsel and email us “one-off” questions on a daily basis; we are often able to answer these questions without any additional research, given how frequently we are advising retailers on the same issues.

  • Secured dismissal of a consumer class action after using metadata on the as-filed complaint to prove that the complaint was finalized within days of the purchase at issue, and weeks before the date that the other side told the court it was prepared.
  • Defended the largest cosmetics company in North America in four putative class actions in both federal and state court concerning advertising representations made about its branded cosmetic products.
  • Defeated class certification in two highly publicized cases alleging that the law schools violated consumer protection statutes by inflating post-graduation employment statistics.
  • Defended dozens of retailers against claims brought under the federal Wiretap Act and California’s Invasion of Privacy Act (CIPA) concerning the alleged recording of chat conversations, use of session replay technology, and use of the Facebook Pixel.
  • Defended a dozen putative class actions alleging that the sale of customer information to data cooperatives and list brokers, who in turn sold their information to telemarketers and other advertisers without notice or their consent, violated state law.
  • Defended 200+ cases alleging that websites were not accessible to site-disabled customers.
  • Prevailed at trial for an iconic department store in a deceptive pricing case prosecuted by the City Attorney of Los Angeles on behalf of the State of California, involving hundreds of millions of dollars in alleged damages. Following the two-week bench trial, the court swiftly rejected the opinions of the People’s expert witness, who was also the expert the state used in two other successful deceptive practices trials—one in a parallel proceeding involving a different defendant on nearly identical claims and another against Overstock that resulted in nearly $7 million in civil penalties.
  • Persuaded the California Court of Appeal In a deceptive pricing action that California’s former price law likely violated the First Amendment, after we previously persuaded the trial court that the statute was unconstitutionally vague. As a result, the other side voluntarily dismissed its claim under the law.

Experience

  • Represented Noble Rock Software in its strategic investment in Energy Worldnet, a leading provider of legally mandated Operator Qualification SaaS solutions for the gas pipeline, utility, and telecommunications industries.
  • Defended more than 80 class actions across the country alleging deceptive pricing practices with an unmatched track record, including in cases where her clients prevailed at trial, summary judgment, class certification, and multiple appeals.*
  • Acting as outside marketing counsel for several household names, which routinely involves reviewing and revising pricing policy; advising on online and in-store marketing campaigns; representing the company in government actions for weights and measures violations; advising on changes to return policy; advising on changes to website’s terms and conditions; and advising on influencer negotiations and related agreements.*
  • In support of a motion to dismiss based on feigned injury, secured prompt voluntary dismissal after introducing video surveillance footage showing Plaintiff taking photographs and videos of in-store price displays at the time she was allegedly duped into making a purchase.*
  • Engaged by largest retailer industry group in the country to prepare comments on updates to the FTC’s Endorsement Guides.*
  • Representing multiple retailers with respect to investigations by California’s “Greenwashing Taskforce” into their advertising of biodegradable and plastic-free products.*
  • Defending fifteen retailers against claims brought under the federal Wiretap Act and California’s Invasion of Privacy Act (CIPA) concerning the alleged recording of chat conversations, use of session replay technology, and use of the Facebook Pixel.*
  • Defended more than 100 retailers in more than 200 filed or threatened lawsuits nationwide alleging violations of federal and state disability laws such as the Americans with Disabilities Act (ADA), California’s Unruh Act, and New York’s Human Rights Law. Met with the Department of Justice in Washington, DC to discuss potential legislative solutions to this onslaught of litigation.*
  • Representing multiple e-commerce companies with respect to investigations by the California Auto Renewal Taskforce (CART) into their subscription programs.*
  • Defending numerous eyeglasses manufacturers and retailers against allegations arising from the company’s claims concerning blue light’s harmful effects and how its products can diminish or lessen those effects.*
  • In a government enforcement action brought by the state of California, obtained a Court of Appeal decision laying the groundwork for finding that California’s former price law violates the First Amendment; in response, the government dropped that significant claim under that statute.*
  • For two high-end clothing retailers, persuaded Plaintiffs to drop threatened claims under California’s Song-Beverly Credit Card Act (which prohibits retailers from collecting customer information as a condition of purchase), after showing their counsel video footage showing one of the plaintiffs had signed a data capture card, which expressly informed her that she was not required to share her information in order to complete her purchase.*
  • Preparing or overhauling pricing policies for eight prominent retailers, and provide in-person trainings to several retailers’ business teams on the new policies.*
  • Defended a dozen putative class action alleging that the sale of customer information to data cooperatives and list brokers, who in turn sold their information to telemarketers and other advertisers without notice or their consent, in violation of state law.*

  • In two separate threatened actions alleging that our retail clients violated California’s gift card laws by failing to provide cash back gift cards valued at less than $10 upon request, we obtained prompt voluntary dismissals after introducing video footage from their purchases showing that Plaintiffs had bought their gift cards just moments before their purchases, asked for price checks to ensure that the resulting balance would be less than $10, and that they failed to request cash back.*
  • In a data breach case involving unencrypted laptop containing medical information of 116,000 patients, where plaintiffs sought $116m in damages, we obtained dismissal of several of the plaintiffs’ claims dismissed at the pleading stage, and settled the remaining claims for a nominal amount.*
  • After negotiating a very low-cost settlement in this class action alleging violations of California’s Song-Beverly Credit Card Act, we opposed Plaintiff’s request for attorneys’ fees, and the court awarded only $135,711 of the $440,445 requested by Plaintiff.*
  • Defeated motion for catalyst fees seeking in excess of $1mm, where Plaintiff argued that client’s change in business practice resulted from the class action they filed.*
  • Secured dismissal of four highly-publicized class actions filed across the country against beloved clothing and outdoor recreation equipment retailer relating to changes to its return policy.*
  • Obtained a dismissal of several putative class action seeking refunds for allegedly defective medical devices, despite the fact that product had been subject to a voluntary recall.*
  • Secured dismissal with prejudice for national consumer health company in defense of consumer class action concerning product labeling.
  • Represented national consumer goods company in putative class action concerning alleged product defect.
  • Defended multiple first-of-their-kind lawsuits under state telemarketing laws.
  • Defended threatened class action regarding the labeling of popular snack foods product.
