In the article, the Benesch team analyzes a recent ruling from the U.S. District Court for the Northern District of Texas dismissing multiple wire fraud charges in connection with an alleged tax shelter scheme. The court held that prosecutors cannot rely on the broader wire fraud statute to pursue conduct that is more appropriately governed by specific criminal tax laws, which require a higher standard of intent.
