Partner Marc Blubaugh Quoted in Freight Waves on Potential Supreme Court Review of TQL Broker Liability Case

Marc Blubaugh, Co-Chair of Benesch’s Transportation & Logistics Practice Group, was quoted in a recent Freight Waves article discussing the ongoing legal debate surrounding broker liability, particularly in the case of Cox v. TQL. The case, currently before the U.S. Court of Appeals for the 6th Circuit, could contribute to a split among the circuits on this issue and potentially pave the way for a U.S. Supreme Court review.
In the article, Blubaugh explains the significance of multiple circuit court decisions in increasing the likelihood of the Supreme Court stepping in to resolve the conflict. He said, “The more circuit decisions that come out, the greater the likelihood that the court would resolve the split among the circuits. It is one of the criteria that the court looks at in addition to whether it is an issue of critical importance to the Supreme Court.”
