Associate Bianca Smith Quoted in The Athletic on NCAA Eligibility Litigation

Bianca Smith, Associate of Benesch’s White Collar, Government Investigations & Regulatory Compliance Practice Group, was quoted in The Athletic article titled, “In LSU and the SEC’s dizzying court battle, one thing is clear: No one’s really in charge.” The article examined the growing uncertainty surrounding NCAA eligibility rules, conflicting court decisions and the broader challenges facing governance in college athletics.

Bianca explained that courts across the country are reaching different conclusions on athlete eligibility issues, making it difficult to establish a consistent national standard. “I think that what people are trying to do is apply rulings from one jurisdiction across the country,” Smith said. “What we’re learning is that each jurisdiction is going to make its own decisions. We’re seeing regional trends, and we’re seeing state trends, but we are not seeing federal and national trends.”
