Benesch Partner Jonathan Todd Quoted in ISM on Evolving Tariff Refund Landscape

Jonathan Todd, co-lead of Benesch’s Transportation & Logistics Practice Group, was recently quoted in an Institute for Supply Management (ISM) article examining tariff refunds under the International Emergency Economic Powers Act (IEEPA) and the ongoing uncertainty facing importers.

In the article, Jonathan discusses the growing use of U.S. Customs and Border Protection’s CAPE system to pursue refunds, as well as the strategic, legal and commercial considerations companies must weigh — including whether to pursue administrative claims, litigation or both. He also highlights concerns around customer expectations, potential disputes over sharing refunds and the evolving enforcement landscape.

“Some importers are a little cautious about it and might choose not to seek refunds. And there are a few reasons for that,” Jonathan said.
