Benesch Partner Jonathan Todd Quoted in Manufacturing Dive on Tariff Refund Uncertainty

Jonathan Todd, vice chair of Benesch’s Transportation & Logistics Practice Group, was recently quoted in a Manufacturing Dive article examining the widespread confusion facing importers after the U.S. Supreme Court’s decision striking down tariffs imposed under the International Emergency Economic Powers Act (IEEPA).
In the article, Todd addresses the ongoing uncertainty surrounding the tariff refund process, noting that key details—including filing requirements, deadlines and timing—remain unresolved. He highlights that while the Court of International Trade has directed U.S. Customs to develop a repayment framework, businesses are still awaiting clear guidance on how and when refunds will be issued.
“I have a number of clients who want to take every action they can, and those tend to file lawsuits,” Todd said. “Others are waiting because they see this as an evolving situation that we will have greater clarity on soon.” He added that some clients are reluctant to pursue refunds due to administrative challenges or “political and commercial reasons.”
