Benesch Partner Mark Silberman Quoted in Modern Healthcare on CMS’ New Fraud Enforcement Initiative

Mark Silberman, Vice Chair of Benesch’s Healthcare Practice Group was quoted in the March 2026 Modern Healthcare article, “Providers on defense as feds ramp up fraud enforcement, deploy AI.” The article examines the Centers for Medicare & Medicaid Services’ (CMS) new Comprehensive Regulations to Uncover Suspicious Healthcare, or CRUSH, initiative and its impact on health systems nationwide.

Silberman, who represents healthcare providers in regulatory and enforcement matters, commented on the potential implications of the CRUSH initiative. “If the initiative addresses fraud in healthcare, I would celebrate it,” Silberman said. “The problem is, so much of the enforcement effort in healthcare has been to pursue hyper-technical regulatory violations with the sole purpose of recovering the funds paid for services already provided.”
