Benesch Transportation Vice Chair Jonathan Todd Interviewed by KNX News Radio on Tariff Refund Litigation

Jonathan Todd, Vice Chair of the firm’s Transportation & Logistics Practice Group, was interviewed by KNX News Radio Los Angeles on the wave of lawsuits following the Supreme Court’s decision striking down certain Trump-era tariffs, including FedEx’s suit seeking refunds of tariff payments.

During the segment, Todd discussed FedEx’s lawsuit against the administration seeking refunds for tariffs the Court recently ruled unlawfully. He explained that companies are taking varied approaches — some waiting for clearer refund procedures, others hesitating for political or business reasons, and some filing suits proactively to preserve their rights. With approximately $170 billion in potential refunds at stake, Todd expects a surge of cases in the Court of International Trade and cautioned businesses to remain compliant as they pursue recovery.

“There’s $170 billion of refunds collected that are up for grabs, and importers into the United States are very eager to get their hands on those,” Todd said.
