Jonathan Todd Interviewed on 7NEWS Australia About Trump’s New 10% Tariff

Benesch Transportation & Logistics Vice Chair Jonathan Todd was interviewed on 7NEWS Australia’s Sunrise morning news show about U.S. tariff law, the Supreme Court’s ruling on prior tariffs and President Trump’s immediate attempt to impose new tariffs using a different legal authority.

In the segment, Jonathan explained the legal and political implications of the U.S. Supreme Court’s ruling that certain tariffs were unlawful. He noted that, in response, President Trump imposed a new global 10% tariff under a different statute—Section 122—which permits temporary tariffs of up to 15% for 150 days in situations involving currency devaluation or financial instability. Jonathan also discussed the likelihood of further court challenges, and the uncertainty importers face regarding potential refunds, as the Supreme Court did not address that issue. Additionally, he commented on President Trump’s criticism of the Court, noting that while such remarks are unusual, they do not affect the constitutional balance among the three branches of government, even when rulings involve justices he appointed.
