Blubaugh noted that his clients generally fall into two camps: those who prefer to address concerns through direct discussions with carriers, and those who want to build more specific compliance language into their contracts. As he explained, “There’s an over-drafting camp…” that seeks to expressly call out key issues in the contract’s compliance section, while others believe additional language isn’t necessary beyond a conversation because brokers and carriers already agree to comply with U.S. laws and regulations in standard agreements.
