Margo Wolf O-Donnell, Co-Chair of Benesch’s Labor & Employment Practice Group, was quoted in a Law360 article titled “Workers Feeling PWFA’s Impact After 1st Year In Effect.”
O’Donnell said, “Employers seem to be on-the-whole sympathetic to the accommodations, but it’s more complex in terms of requests for leave.”
Seeking a short time away during a pregnancy isn’t a big deal, but a longer time frame can be tougher for employers to greenlight. Like under the Americans with Disabilities Act, companies can turn down a worker’s PWFA accommodation request if it would pose an “undue hardship” on their business.
Remote work requests have also presented hurdles, as some companies are really hoping for their employees to return to in-person work.
