The largest patent damages verdicts of 2024 reached nine figures, consistent with recent years, though none surpassed $1 billion as seen earlier in the decade. The largest award, $847 million, was overturned post-trial, highlighting increased scrutiny on sizable damages.
Most of the largest patent damages awards in history have never been collected, so “if one trend jumps out at me, it’s that the very highest of these awards tend not to survive scrutiny in post-trial motions and appeal,” said McMahon.
