Michael Vatis, a Partner in the firm’s Litigation Practice Group focused on data and cybersecurity, was featured in Bloomberg Law discussing a recent Massachusetts court ruling on the state’s Wiretap Act.
In this decision, the Massachusetts Supreme Judicial Court determined that using web tracking tools, such as Google Analytics and Meta Pixel, does not violate the state’s Wiretap Act. The case, which involved two hospitals, narrows the interpretation of the Act to exclude routine website interactions, likely setting the stage for further litigation in the state.
Vatis, who filed an amicus brief in the case on behalf of national and state retailers’ associations, noted that other states “will find this reasoning to be persuasive in interpreting other states’ laws and so they may interpret their statutes narrowly as well.”
