Nathan is an experienced litigator who represents both public and private companies in state and federal courts, as well as in arbitration. His practice focuses on complex business and commercial matters, contract disputes and consumer-related litigation, including class action defense.

Nathan has represented business entities of all sizes across a wide array of industries. He has helped his clients successfully resolve disputes through all phases of litigation, from initial counseling prior to the initiation of formal proceedings to all stages of discovery and motion practice, and ultimately to resolution through settlement or trial.

Before joining Benesch, Nathan clerked for the Honorable Pamela A. Barker of the United States District Court for the Northern District of Ohio. While clerking, Nathan gained valuable insight into the judicial decision-making process, which he uses throughout his practice to help his clients strategically navigate each stage of litigation.

Nathan is also active in the community, regularly volunteering as a member of the Associate Board of the Literacy Cooperative, which seeks to raise awareness and improve literacy levels throughout the Cleveland area.

Representative Experience

  • Represented a global manufacturing company in a lawsuit against an Israeli subcontractor that refused to release several multimillion-dollar pieces of equipment due to a payment dispute, and obtained a temporary restraining order in U.S. court requiring the subcontractor to make the equipment available for immediate pickup.
  • Achieved dismissal of a consumer class action seeking millions in damages alleging multiple violations of consumer protection laws, on behalf of a national home improvement and services retailer.
  • Obtained early voluntary dismissal of product liability, breach of warranty and negligence claims against an HVAC systems supplier following the filing of a motion to dismiss.
  • Successfully enforced an arbitration agreement requiring individual arbitration against a consumer seeking to escape its terms, preventing the filing of a potentially costly and damaging nationwide class action.
  • Successfully defended a telehealth provider against a RICO claim filed by a competitor.
