The American Lawyer’s Litigation Daily has recognized Partners Nicholas Secco, Alyssa Moscarino and Abbey Walsh in the Litigator of the Week Runners-Up and Shout-Outs for their representation of Professional Bull Riders (PBR) in a closely watched challenge to Merit Street Media’s Chapter 11 filing.
Following a bench trial, U.S. Bankruptcy Judge Scott Everett (N.D. Tex.) converted the case to Chapter 7, finding that Merit Street backer Dr. Phil McGraw intentionally deleted text messages which reflected his plans to improperly use bankruptcy as a platform for launching a new network and evading creditors. The ruling ensures PBR’s rights are protected and reinforces that candor and good faith are non-negotiable in bankruptcy proceedings.
