Copyright & Trademark Litigation

With a winning track record across trademark, copyright and unfair competition matters, Benesch’s powerhouse Copyright & Trademark Litigation team combines aggressive legal strategy, deep industry insight and trial-tested litigation experience to protect the brands, creative assets and reputations of leading businesses, creators and innovators.

Our lawyers aggressively protect global brands, artists, media companies, tech innovators and artists in litigation involving infringement, misappropriation, counterfeiting and false advertising allegations across a range of industries—from fashion and consumer goods to entertainment, publishing, tech and SaaS.

Whether you’re defending your brand, enforcing your rights or navigating a split, Benesch’s focused, formidable advocacy helps you come out ahead.

We represent plaintiffs and defendants in litigation involving infringement, licensing, dilution, misappropriation, counterfeiting, DMCA takedowns and unauthorized commercial use of names, images and likenesses. From high-stakes litigation against national brands to fast-moving actions that demand strategic speed and discretion, we deliver clarity and leverage.

We enforce and defend IP rights in federal and state courts, the U.S. Patent and Trademark Office, the Trademark Trial and Appeal Board (TTAB) and arbitration forums. We routinely secure early wins through dismissal, summary judgment or injunction, and we are equally prepared to go the distance at trial or on appeal when needed.

A Nationally Recognized, Uniquely Equipped Team

Benesch offers a rare blend of legal firepower and industry fluency. Our team includes a Grammy-nominated producer and music copyright authority, attorneys with extensive experience in fashion, software and media law and recognized leaders who shape how the courts and the market understand IP law. We know the playbook because we helped write it.

Our Work In Action – Representative Examples

  • Won a complete defense verdict in trademark infringement, unfair competition and tortious interference litigation brought by a hearing instrument manufacturer.
  • Secured a dismissal in a case where plaintiffs alleged our client’s Terms and Conditions violated California’s “Yelp Law.” The disputed provision, found in the section on trademark use, was claimed to be a non-disparagement clause. The Court agreed with our argument that subsection (a)(1) does not create a private right of action, and found plaintiffs failed to allege facts under subsection (a)(2). Their claims, including under the UCL, were dismissed without leave to amend.
  • Represented a music publisher in copyright litigation against a multinational film and television company, securing a favorable settlement.
  • Represented a major fashion retailer in copyright and trade dress litigation over teen clothing designs.
  • Led internal disputes over the use of federally registered band names and music rights on behalf of globally recognized artists.
  • Successfully represented Fitness Quest in copyright infringement litigation over music-related content.
  • Successfully represented Sony Records in a copyright infringement action related to plaintiff’s copyright infringement allegation (dismissed after case was fully briefed).
