Benesch Client, Sephora USA, Inc., obtains significant victory in putative class action lawsuit.

Sephora USA, Inc., obtained a significant victory in a putative class action lawsuit brought against it by a Plaintiff alleging violations of Ohio’s Consumer Sales Practices Act relating to Sephora’s alleged product marketing. In addition to denying plaintiff’s class certification motion, the court found that plaintiff lacked standing to sue as a so-called “private attorney general” where her claim of standing was premised solely on that basis. The case is Kupfer v. Sephora USA, Inc., Cuyahoga County Court of Common Pleas, case no. CV-15-842636. Jeremy Gilman and Nora Cook represent Sephora in the litigation.
