Duncan structures, negotiates and closes complex real estate-related transactions for clients in New York, New Jersey and beyond, and represents cannabis industry clients in business transactions, advising on operations and resolving regulatory and licensing matters. His clients range from institutional and nontraditional lenders and borrowers to developers, funds, entrepreneurs, commercial landlords and tenants, as well as the wide variety of businesses operating in the cannabis space.
Duncan handles acquisitions, dispositions of real estate and debt, joint ventures, leasing, sale-leasebacks and syndications involving office, retail, industrial, hospitality and mixed-use properties across the nation. His experience also includes mortgage, construction, bridge and mezzanine loans, repurchase lending, participations, co-lender and intercreditor agreements, collateralized loan and debt obligations, and other financings, loan modifications, restructurings and workouts.
In the cannabis space, Duncan is at the forefront of the highly regulated adult-use markets in New York and New Jersey. He helps clients acquire, maintain, finance and sell cannabis licenses in New York and New Jersey, structure and scale cannabis businesses, and ensure regulatory compliance. Representing clients across the sector, including startups and other entrepreneurs, multistate operators, cultivators, processors, wholesalers, distributors, dispensaries and delivery services, as well as investors, landlords, and ancillary businesses, he possesses a comprehensive view of the industry and the challenges those in it face.
Regarded as a leader in the emerging field of cannabis law, Duncan chairs the New York City Bar Association’s Cannabis, Drugs & the Law Committee.
