Eric has represented employers before state and federal courts and administrative agencies.
Eric’s litigation experience includes actions arising out of wage and hour disputes, the Americans with Disabilities Act (ADA), the Family and Medical Leave Act (FMLA), and discrimination claims under Title VII of the Civil Rights Act and analogous state laws. Eric’s practice also includes employer representation at collective bargaining negotiations and resolution of grievances under a collective bargaining agreement and unfair labor practice charges under the National Labor Relations Act (NLRA). In addition, Eric has experience in mergers and acquisitions and the satisfaction of due diligence obligations in both equity and asset transactions.
Eric also counsels employers regarding best practices on a variety of employment matters, including employee vacation and other leave policies, employee/independent contractor and exempt/non-exempt classification, compliance with the NLRA, compliance with the Fair Credit Reporting Act (FCRA) in conducting background checks and other pre-employment screenings, and the preparation of severance agreements and noncompetition agreements.
Representative Experience
- Represented a global leader in the formulation, development and manufacture of performance polymer solutions in its acquisition of a developer of premium thermoplastic elastomer (TPE) materials for manufacturers across a diverse range of industries throughout North America, Asia and Europe.
- Represented Qualus Power Services, a portfolio company of New Mountain Capital, in its acquisition of Ferreira Power Group, a specialized power engineering firm providing distribution palling and design, grid hardening, and program management for utility providers.
