Overview
Rachel represents healthcare clients in regulatory, transactional, and litigation matters with an emphasis on post-acute and long-term care providers, as well as providers who provide services in to long-term care facilities. She represents a variety of both nonprofit and for-profit healthcare providers, including hospices and palliative care programs, home health agencies, skilled nursing facilities, assisted living facilities, physicians, physician practices and physician practice management companies.
Rachel counsels clients undergoing federal and state audits and investigations, including audits and investigations conducted by the Office of Inspector General, the New York State Office of Medicaid Inspector General, and the Centers for Medicare and Medicaid Services Medicare Administrative Contractors. She regularly counsels clients and assists in the defense of providers in fraud and abuse matters, including claims of fraud and anti-kickback, self-referral, corporate practice of medicine, and fee-splitting violations. Rachel has represented numerous providers through the Medicare audit and appeals process. She has also represented investors, owners, and operators of a variety of healthcare entities with regulatory and corporate due diligence and complex corporate restructurings, sales, and acquisitions.
In addition, Rachel assists clients with developing and implementing compliance programs and conducting compliance audits. Rachel also advises clients in all aspects relating to certificate of need, facility licensure and professional licensing, Medicare and Medicaid survey issues, and healthcare privacy and security matters.
Rachel is also a physician assistant licensed to practice in New York since 1996. Rachel previously served as in-house associate general counsel and corporate compliance officer for a home care company with operations in 11 states.
