He often manages cases from start to finish and is frequently called upon for his proficiency in briefing and argument on particularly complex legal issues.
In addition to his commercial practice, Josh maintains an active pro bono docket focused on immigration and asylum matters. He is also a frequent speaker on bankruptcy and insolvency topics, having presented CLEs and participated in related panels.
Josh is committed to being the advocate clients want in their corner when facing highly complex, seemingly “no win” situations, and he is dedicated to delivering results through thoughtful strategy, creative advocacy and tireless client service.
Experience
Defended a publicly traded food products distributor in a mass products liability action in state court while simultaneously pursuing recovery in federal district and bankruptcy court against the client’s insolvent co-defendant and its insurers. Managed extensive document and discovery processes, drafted discovery motions, prepared witnesses for deposition, drafted motions for summary judgment and motions in limine, and assisted with trial preparation. The team’s efforts resulted in a favorable settlement for the client, allowing them to avoid a trial that ultimately led to a ten-figure judgment against the co-defendants.*
Represented a major oil and gas producer in an environmental class action arising from the operation of the client’s refinery. Handled demurrer and class certification briefing and coordinated the investigation into potential mechanisms of contamination and environmental factors that complicated attribution.*
Represented the trustee appointed to liquidate an international fintech company accused of perpetrating a complex fraud involving securitized reinsurance transactions. Led associates in litigating the client’s defense of fraud and constructive trust claims and in prosecuting actions to recover against the client’s directors and officers, insurers, management consultants and other culpable professionals.*
