Overview

Puja is a seasoned trial attorney with over a decade of experience representing emerging and established companies on both sides of the “v” in high-stakes and bet-the-company intellectual property litigation and complex commercial disputes. With a focus on patent, copyright and trade secret litigation, Puja has a proven track record of success helping clients in the generative artificial intelligence, life sciences, medical device, software and broader technology sectors resolve issues in federal court, at arbitration and before the Patent and Trademark Office. 

Puja is also one of a small number of litigators in the country with direct, hands-on experience at the intersection of AI and intellectual property litigation, having served as counsel for OpenAI in the multi-district copyright lawsuits that are actively defining the boundaries of copyright fair use as applied to generative AI. As a result, Puja has firsthand knowledge of the unique pressures and strategic considerations AI companies face in litigation.

Complex Commercial Disputes

Trained as a commercial litigator with IP issues as one aspect of her practice, Puja has broad-based knowledge and experience in a variety of litigation including breach of contract, breach of fiduciary duty, trade secret misappropriation, and white-collar matters. 

Puja has led case teams from discovery through trial, managed multijurisdictional litigation and is frequently called upon for her oral advocacy skills in pivotal moments. Recently, her in-court examinations resulted in a trial victory on behalf of a medical device manufacturer in a billion-dollar patent dispute against its global competitor, and she obtained a permanent injunction to protect a major technology company’s copyrights and trade secrets. Puja has also been at the forefront of driving litigation to establish the bounds of copyright fair use as applied to generative AI, she has deposed dozens of fact and expert witnesses, and she has argued key dispositive motions. She is recognized for building enduring client relationships grounded in trust, strategic judgment and a proven track record of success.

Prior to joining Benesch, Puja worked at Keker, Van Nest & Peters and Latham & Watkins. She clerked for Judge John K. Bush for the U.S. Court of Appeals for the Sixth Circuit and Chief Judge Theresa Springmann of the U.S. District Court for the Northern District of Indiana. She has been recognized in Best Lawyers in America: Ones to Watch – Commercial Litigation (2025, 2026) and as an LCLD Pathfinder.

Representative Matters:

  • Served as lead trial counsel in a series of multi-district copyright lawsuits against a major generative AI company that will establish the boundaries of copyright fair use as applied to generative AI, including preparing key discovery motions related to work product protection over inputs and outputs.*
  • Defended a major medical device manufacturer in the District of Delaware against its global competitor, where the competitor asserted a dozen patents targeting the accused product. Narrowed the case to four patents prior to trial, including by invalidating a patent at summary judgment. Secured a win following a two-week trial after the jury invalidated another asserted patent, found no infringement for two patents, and the court declined to let the jury consider damages on the remaining patent.*
  • Defended a life sciences SaaS company in a trade secret dispute against a regional competitor, achieving a favorable settlement and dismissal through targeted discovery and Daubert challenges.*
  • Represented a major technology company in a plaintiff-side copyright lawsuit against its competitor. After filing the complaint alleging claims under the Copyright Act, Texas Harmful Access to Computers Act, and Digital Millenium Copyright Act, the defendant stipulated to a comprehensive permanent injunction under which the company agreed not to scrape, display, publish, reproduce or distribute any copies or derivatives of the company’s copyrighted images.*
  • Secured favorable settlement as pro bono lead trial counsel on behalf of a pre-trial detainee in an excessive force suit against the City and County of San Francisco.*
