The article highlights a closely watched Illinois Supreme Court decision clarifying that speculative future harm is insufficient to establish common law standing for claims seeking statutory damages. Patrick described the ruling as “huge for the defense bar,” noting that “Illinois has been sort of a safe haven for plaintiffs, and particularly class action plaintiffs, who lack standing [in federal court] because of Article III, and now they can’t use the state courts as a back door.”
