Overview

Avery advises clients across the energy sector on regulatory proceedings, investigations and transactional matters before state public utility commissions, regional transmission organizations (RTOs), independent system operators (ISOs) and the Federal Energy Regulatory Commission (FERC). She works closely with clients to navigate the ever-changing regulatory landscape and anticipate policy developments that impact their businesses nationwide.

Avery represents a wide range of energy market clients, including gas and electric utilities, data centers, generators, renewable energy companies and energy traders. She regularly handles electric and natural gas regulatory matters, including administrative litigation, regulatory compliance, market manipulation investigations and project development transactions, particularly in connection with natural gas pipeline development. She also advises on renewable energy transactions, including power purchase agreements and wholesale and retail behind-the-meter arrangements.

A key aspect of Avery’s practice involves counseling clients on emerging and rapidly developing energy issues. She regularly advises on federal and state regulatory considerations related to cryptocurrency mining and the proliferation of data centers. Her experience also includes advising on Inflation Reduction Act investment tax credits for energy projects and the Commodity Futures Trading Commission’s voluntary carbon credit derivatives.
