Dave supports clients ranging from family-owned businesses to Fortune 500 companies in complex commercial cases and consumer class actions. Whether advising in state or federal courts or engaging in private arbitration, he approaches every case with his clients’ goals and business needs at the forefront.
Dave’s experience spans the entire lifecycle of litigation, which includes:
- Crafting insightful pleadings and targeted motions to strategically position clients for success from day one;
- Managing discovery effectively to build a strong record for summary judgment, class certification, mediation, settlement negotiations and trial; and
- Preparing and taking cases to trial with a sharp focus on the legal and factual issues that will drive favorable outcomes.
Dave is quick to adapt to the broad range of industries and legal issues presented in commercial litigation and consumer protection and class action matters. He has represented clients in the banking, retail, transportation & logistics and technology manufacturing industries, among others. His experience encompasses a wide array of legal issues including contract disputes, trade secret litigation, consumer actions under federal banking and lending laws and consumer privacy class actions under the Telephone Consumer Protection Act, Electronic Communications Protection Act and state law equivalents.
This versatility and commitment to understanding each client’s unique circumstances are what drive Dave’s practice. He recognizes that clients’ legal needs do not exist in a vacuum and strives to provide solutions tailored not just to the moment, but to the bigger picture.
Prior to joining Benesch, Dave externed for the Hon. Benita Y. Pearson of the U.S. District Court for the Northern District of Ohio and honed his skills in defamation matters as a licensed legal intern at the Dr. Frank Stanton First Amendment Clinic at Case Western Reserve University School of Law.
Experience
Represented an ENR-ranked Midwest specialty contractor in a cross-border dispute over cost overruns and withheld payments on a steel manufacturing plant. The contractor significantly underbid the project due to misleading actions by the owner. Benesch re-baselined the schedule, developed a damage model and used an estoppel argument to secure a favorable settlement in fast-track arbitration.
