Mark is an experienced trial lawyer, health care attorney and litigator. His practice focuses on helping health care professionals and businesses navigate the complex and changing landscape of health care with an emphasis on achieving governmental and regulatory compliance.
Mark concentrates on managing internal and external health care investigations, False Claims Act cases, white collar criminal defense, all forms of health care litigation, and all aspects of the Illinois Certificate of Need program.
Mark handles audit, compliance, investigations and enforcement actions involving HHS-OIG, the Medicare/Medicaid programs, the Illinois Department of Public Health, and Illinois Health Facilities and Services Review Board (Certificate of Need). He advises clients regarding managing and avoiding allegations of health care fraud and health care-related criminal conduct, addressing concerns related to the Anti-Kickback Statute, and pharmacy and pharmaceutical related litigation. He provides counsel and litigation services for physicians, facilities and pharmacies engaged with any federal agency, along with handling Medicare/Medicaid reimbursement issues, False Claims Act/Qui Tam defense, and various health care transactional matters. Mark also serves as the outside General Counsel to the American Association of Nurse Anesthetists.

Mark has broad experience with a variety of “white collar” investigations and actions. He has handled internal and external investigations into regulatory compliance, designed and implemented corporate integrity agreements, responded to criminal and civil government inquiries, dismantled and defended False Claims Act allegations, supervised internal and external regulatory audits, audited and implemented compliance plans, and prepared notification and disclosures as necessary following internal investigations into compliance issues. Mark’s experience allows him to help client create a compliance framework designed to avoid the avoidable problems, thereby allowing their focus to remain on their chosen business. Mark knows how to navigate government, a skillset upon which his clients rely.
Mark’s practice focuses on both assisting clients to avoid compliance and regulatory issues as well as litigating those issues when necessary. Mark is a capital litigation certified trial attorney. He has handled dozens of jury trials (including several first degree murder trials) and hundreds of bench trials and administrative hearings throughout his twenty year career.
Mark’s experience inside and outside the courtroom is the foundational basis for Benesch’s GRACE initiative (Government Regulatory Avoidance Compliance and Enforcement). The approach is designed to leverage the team’s broad experience in managing investigations, designing and promoting regulatory compliance, and improving and implementing compliance programs, with its frontline insight into government investigations and analytics.

As the former General Counsel of the Health Facilities and Services Review Board, represented a group of nursing homes before the Board, in the Circuit Court, and at the Appellate Court to support a decision of the Certificate of Need Board. See, ManorCare Health Services, LLC v. Illinois Health Facilities & Services Review Board, 2016 IL App (2d) 151214. The case was a landmark case resulting in clarification of the Board’s authority to interpret its own regulations and to utilize its discretion in making decisions regarding the design and advancement of health care in Illinois.
Helped U.S. HealthVest obtain regulatory approval to establish a new 100-bed specialty hospital in Northbrook, Illinois, thus fundamentally improving access to mental health and addiction care for a major portion of Lake and Cook Counties. See Project # 16-011 – Northbrook Behavioral Hospital, Northbrook.
Represented long-term care pharmacy in DEA audits and compliance investigations.
Represented a rehabilitation company throughout a government investigation resulting in government decision not to pursue civil or criminal charges.
Represented a medical biller facing an investigation due to alleged misconduct of employer with the goal of ensuring appropriate protections while navigating a cooperative process.
Represented a long-term care facility in a multiple-year government investigation, including seizure of computer systems without charges being filed, and effected return of all seized records and materials.
Represented a Home Health Agency owner in a government investigation to alleged misconduct and successfully exhibited to the government the perceived misconduct had not occurred, resulting in no charges being filed.
Represented a compounding pharmacy related to a DEA-issued Order to Show Cause, an administrative hearing, and a counterclaim seeking injunctive relief to dissolve an order of immediate suspension.
