Fraud & Abuse

Benesch’s Healthcare Practice Group provides comprehensive counsel on the full spectrum of federal and state health care fraud and abuse laws, which are both wide-ranging and complex.

Overview

Our team is highly knowledgeable in navigating the federal anti-kickback statute, safe harbor regulations, relevant case law, and guidance from the Office of Inspector General (OIG), including advisory opinions, “fraud alerts,” and other OIG and Centers for Medicare and Medicaid Services (CMS) issuances. We are also well-versed in the “Stark” (physician self-referral) statute, its regulations, case law, and advisory opinions.

Our attorneys handle matters involving federal statutes that establish criminal offenses and grounds for civil monetary penalties and exclusion from federal health care programs, as well as the federal False Claims Act and related case law, including private “whistleblower” actions.

Additionally, we provide guidance on the OIG Voluntary Disclosure Protocol, helping clients address and resolve potential compliance issues efficiently and effectively.
