Lidia focuses her practice on Intellectual Property Litigation. Lidia’s practice covers both litigation and transactional work, focusing on copyright, media, entertainment, trademark, and right of publicity/privacy law. She has experience in handling complicated litigation matters in these areas in federal and state courts, and in counseling clients regarding strategic protection, content risk, and compliance issues.

Lidia gained a wide variety of entertainment, copyright, trademark, media, and advertising experience while externing for NBCUniversal in their TV Legal Division and for the Federal Trade Commission. Lidia also gained valuable, on-the-ground litigation training at an intellectual property litigation firm, where she represented clients in bet-the-company patent and technology litigations, and at the Ohio Attorney General’s Office, where she represented Ohio’s executive officials, departments, and agencies at all stages of civil litigation in trial and appellate proceedings, in state and federal court.

By understanding the creative process as a musician and lawyer, Lidia works to give creators and intellectual property the unique protection that they need.   

Successfully resolved disputes involving:

  • Copyright infringement and CMI defense involving music, photographs, videos, text, designs, fabric, software, and other creative content, with a focus on social media allegations
  • Large-scale DMCA takedown notice disputes and counter-notices
  • Fair use defense litigation
  • Right of publicity claims (when tied to content or media use)
  • Licensing disputes and alleged overuse or misuse of content

Representative Experience

  • Draft and negotiate major brand trademark, technology, and copyright out- and in-licenses for range of consumer products, including in food, toy, home goods, apparel, cleaning, technology, and other product categories.
  • Routinely defend non-profit organizations from photograph infringement allegations adverse major photograph licensors.
  • Successfully defended major apparel retailers from fabric and design infringement and CMI allegations.
  • Routinely counsels clients (including big apparel and consumer product brands, housing complexes, and large business complexes) on complying with PROs.

  • Routinely reviews and counsels clients on music licensing in marketing materials (print, Internet, TV), including offering workarounds based on variable licensing structures.

  • Successfully defended several copyright infringement actions brought against technology/social media clients by photographers.

  • Successfully negotiates against PROs to resolve alleged infringements and enter client-favorable licensing deals.

  • Organize, structure, and create DMCA policies to ensure safe-harbor protection under the U.S. Copyright Act.

  • Organize, structure, and create social media creative content policies for big apparel brands.

  • Routinely reviews and counsels clients on music licensing on popular social media platforms.
